Welcome to Synk AI! These Terms of Service ("Terms") govern your use of the Synk AI mobile application, website, and services. By accessing or using Synk AI, you agree to these Terms. Please read them carefully.

What is Synk AI?

Synk AI is a comprehensive health and goal-tracking application designed to help you:

• Build and maintain healthy habits
• Track daily, weekly, and long-term goals
• Integrate with Apple Health for holistic wellness tracking
• Visualize your progress through streaks, charts, and insights
• Achieve personal growth through gamification and motivation tools

Synk AI is available as a mobile application for iOS and Android devices. These Services are provided to you by Synk AI Inc. ("Synk AI", "we", "us", or "our").

By creating a Synk AI account or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines (if applicable).

1. Who Can Use Synk AI?

Age Requirements

• General Users: You must be at least 13 years old to create a Synk AI account and use our Services.
• European Economic Area (EEA): If you reside in the EEA, you must be at least 16 years old to use Synk AI.
• Parental Consent: If you are under 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly collect personal information from children under the applicable age limits without parental consent. If we discover that a user under the applicable age has provided us with personal information, we will delete that information promptly.

Account Eligibility

By using Synk, you represent and warrant that:

• You meet the age requirements stated above
• You have the legal capacity to enter into these Terms
• You will use Synk AI only for lawful purposes and in compliance with these Terms
• All information you provide during registration is accurate, current, and complete
• You will not create multiple accounts for yourself
• You will not allow others to use your account

2. Account Registration and Security

Creating Your Account

To access most features of Synk AI, you must create an account. When you register, you agree to:

• Provide accurate and complete information
• Maintain and update your information to keep it current
• Create only one account for your personal use
• Keep your password secure and confidential

You may register using Email and password, Apple Sign-In, or Google Sign-In (Android).

Account Security

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your login credentials
• Notifying us immediately of any unauthorized access or security breach

Please contact us at support@synkapp.com if you suspect unauthorized use of your account.

Account Termination

You may delete your account at any time through: App Settings → Account → Delete Account

Note: Deleting your account does NOT automatically cancel your subscription. You must separately cancel your subscription through the platform where you subscribed (Apple App Store or Google Play).

3. Subscriptions and Payments

Synk operates on a freemium model. Core features are available for free, with premium features accessible through paid subscriptions.

Free Version

• Basic habit and goal tracking
• Limited health metrics
• Basic progress visualization
• Access to community features

Premium Subscriptions

Premium subscriptions ("Synk AI Premium" or "Premium Services") provide access to:

• Unlimited goals and habits
• Advanced analytics and insights
• Apple Health integration and sync
• Customizable themes and icons
• Priority customer support
• Ad-free experience

Free Trial

We offer a 7-day free trial for new Premium subscribers.

Billing and Payments

Payment Authorization: By subscribing to Premium Services, you authorize us to charge your designated payment method at the start of each billing cycle.

Payment Methods: Payment is processed through Apple App Store (iOS) or Google Play Store (Android). We do not directly collect or store your payment card information.

Automatic Renewal: Your Premium subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Cancellation and Refunds

How to Cancel:

• iOS: Settings → [Your Name] → Subscriptions → Synk AI → Cancel Subscription
• Android: Google Play Store → Menu → Subscriptions → Synk AI → Cancel Subscription

Cancellation takes effect at the end of your current billing period. You will retain access to Premium features until that date.

Refund Policy: All purchases are generally non-refundable except as required by law or at our sole discretion. EEA Residents have the right to a full refund within 14 days of purchase if Services haven't been substantially used.

Important: Deleting the Synk AI app from your device does NOT cancel your subscription. You must cancel through the platform where you subscribed.

4. Health and Safety Information

Consult Your Healthcare Provider

You should always consult with a qualified healthcare provider before:

• Starting any new diet, exercise program, or wellness routine
• Making changes to your current health regimen
• Using Synk AI if you have any pre-existing medical conditions
• Using Synk AI if you are pregnant, nursing, or taking medications

Never disregard professional medical advice or delay seeking medical treatment because of information you accessed through Synk AI.

5. User Content and Intellectual Property

Your Content

"User Content" means any information, data, text, notes, photos, or other materials you create, upload, or provide through Synk AI. You retain ownership of your User Content.

License You Grant to Us

By providing User Content through Synk AI, you grant us a limited, non-exclusive, royalty-free, worldwide license to:

• Store, process, and display your User Content to provide Services to you
• Use anonymized, aggregated data for analytics, research, and service improvement
• Create backups and derivative works as necessary to provide Services

Important Limitations: We will NOT use your identifiable personal health data for advertising purposes and we will NOT sell your personal User Content to third parties.

6. Acceptable Use and Prohibited Conduct

By using Synk AI, you agree that you will NOT:

• Use Synk AI for any illegal purpose or in violation of any laws
• Violate the rights of others, including privacy, publicity, or intellectual property rights
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Perform any activity that could harm Synk AI’s reputation or user experience

Healthy Habits Only

Synk AI is designed to promote healthy, sustainable habits. We do NOT permit the use of Synk AI to:

• Track dangerously restrictive eating habits
• Promote eating disorders or unhealthy weight loss practices
• Encourage excessive exercise or overtraining
• Glamorize self-harm or dangerous behaviors

7. Third-Party Services and Integrations

Synk AI may integrate with third-party services like Apple Health. Your use of third-party services is governed by their respective terms. We are not responsible for the availability, accuracy, or reliability of third-party services.

8. Disclaimers and Limitations of Liability

To the maximum extent permitted by law, Synk AI is provided "as is" and "as available" without warranties of any kind.

We make no warranties regarding the accuracy of health data, the reliability of user content, or the results you may achieve using Synk AI. Our total liability to you for all claims shall not exceed the greater of $100 USD or the amount you paid to Synk AI in the 12 months preceding the claim.

9. Dispute Resolution

If you have a dispute with Synk AI, please contact us first to attempt informal resolution. If we cannot resolve it, you agree to resolve claims through binding arbitration rather than in court, with certain exceptions. You also agree to a class action waiver.
